Abstract. There is an ongoing debate in the philosophical and jurisprudential literature regarding the nature and possibility of Contract theory. On one hand, are those who argue (or assume) that there is, or should be, a single, general, universal theory of Contract Law, one applicable to all jurisdictions and all times. On the other hand, are those who assert that Contract theory should be localized to particular times and places, perhaps even with different theories for different types of agreements. This (...) article considers one facet of this debate: evaluating the relevance of the fact that the remedies available for breach of contract can vary significantly from one jurisdiction to another. This wide variation in remedies for breach of a (contractual) promise is one central difference between promises in morality and enforceable agreements in law. The article asserts that variation of remedies strongly supports the conclusion that there is (and can be) no general, universal theory of Contract Law. (shrink)

Over the past thirty years, academic dialogues on the relationships between the sciences and religions have flourished, albeit primarily within Judeo-Christian historical, theological and philosophical contexts. Can a Hindu tradition be brought into this dialogue? The Bhagavata Purana is one of the most well-known sacred texts of India, and biology, Darwinism in particular, has become one of the most spirited areas of the science and religion dialogue in academia, as well as in the popular media. This thesis examines the possibility, (...) scope and foundational topics involved in a dialogue between Vaisnava-Hindu theology as found in the Bhāgavata, and the theoretical, philosophical and theological issues surrounding contemporary biology. To examine the possibility and scope of a Bhāgavata-science dialogue, I focus on the theological, ontological, epistemological and teleological presuppositions that each tradition bring to the study of nature, outlining the similarities and differences in their approaches. I establish the grounds for further discussion through a comparative analysis of terms such as "consciousness," "knowledge" and "goal of knowledge" as they appear in the Bhagavata and noteworthy Darwinian texts. My argument is that although prima facie the two traditions appear different in their philosophical, scientific and theological approaches, there are a number of areas of common interest and parallels, especially in their epistemologies and teleologies. In the case of genuine differences, such as their views on the ontology of consciousness, I demonstrate the possibility of reconciliation. Clarifying the conceptual differences, establishing parallels and demonstrating areas of common interests opens the possibility and widens the scope for further dialogue. (shrink)

I have become more convinced, over the years, by the truth of Wittgenstein’s characterisation of philosophy as arising through misconceptions of grammar. Such a misconception of grammar characterises a very popular approach to indexicality which has been current since the 1970s, stemming from the work of Casteñeda, and Kaplan. Gareth Evans was inclined to allow, for instance, that one could say ‘“To the left (I am hot)” is true, as uttered by x at t iff there is someone moderately near (...) to the left of x such that, if he were to utter the sentence “I am hot” at t, what he would thereby say is true’ (Evans 1985: 358). But not only does this disturb the proper relation between direct and indirect speech, it continues a Fregean tradition which these very cases show to be quite mistaken about the logic of intensions. In this paper, however, I want primarily to point out how this misconception of grammar has distorted our view of people. For some of the above thinkers have tried to make out that human motivation is related to the possession of a certain category of indexical belief, by Lewis called ‘de se beliefs’. I shall look here at how the matter arises in Hugh Mellor’s work on Time. In connection with Time, indexicality arises in McTaggart’s ‘A-series’, and Mellor treats this indexicality in parallel with Evans’ language. First, therefore, I aim to show how Mellor’s discussion of Time grammatically misconceives the situation, and leads to a misrepresentation of the motivation of human action. But a larger conclusion about Fregean intensions is also then immediately available. (shrink)

?Moral Black? and Whitemail? is a study of those modes of action which involve what I propose to call ?a raising of the moral stakes?. Illustration: A wants B to do X, and B wants to do Y; so A creates a situation in which doing Y would either be morally objectionable or more objectionable than it would have been but for A's intervention. Such modes of action include all the varieties of moral blackmail as well as such practices as (...) those of returning good for evil, putting people on trust, and some kinds of non?violent resistance. I try to expose the distinguishing marks of moral blackmail, why it is thought so objectionable, and how it is related to these other practices that also involve a raising of the moral stakes. The study as a whole is intended to underline the ambiguous nature of human action. (shrink)

We have empirically examined the relationship between top executives’ turnover and the corporate environmental responsibility by identifying the influence of ten specific turnover reasons resulting in the chairman’s departure and two important types of chairman’s succession. Using a sample of 782 manufacturing listed companies across 3 years in China, we find that the corporate environmental responsibility is negatively associated with the involuntary and negative turnover (i.e., dismissal, health and death, and forced resignation) and positively associated with improving corporate governance, and (...) not associated with the normal turnover (i.e., retirement and contract expiration) and the types of chairman’s succession (i.e., independence, and internal or external promotion). Our study significantly contributes to research in environmental disclosure by revealing the relationship between chairman’s turnover and the corporate environmental responsibility. A feasible way is suggested to regulators and other stakeholders in monitoring or assessing the possible abnormality of environmental responsibility when firms experience involuntary and negative chairman’s turnover in the emerging economies. Two of the three volumes contain extensive Latin commentaries on the major writings of Aristotle.2 The third is a miscellaneous volume written in three different hands, which contains, among other things, a complete French translation of the extant writings of Sextus Empiricus (c. A part of relativistic dynamics is axiomatized by simple and purely geometrical axioms formulated within first-order logic. A geometrical proof of the formula connecting relativistic and rest masses of bodies is presented, leading up to a geometric explanation of Einstein's famous E = mc² . The connection of our geometrical axioms and the usual axioms on the conservation of mass, momentum and four-momentum is also investigated.

According to some testimonies, the Aristotelian ethics have been torn between a hedonist reading, as much as an anti‑hedonist one, throughout Antiquity. From Critolaos to Verginius Rufus and Sosicrates, pleasure is considered both as “an evil [that] gives birth to many other evils” and as the first appropriate thing and the supreme good. This noteworthy disagreement stems from a famous difficulty within the Aristotelian corpus, raised by Aspasius, i.e. the alleged coexistence of two ‘definitions’ of pleasure in Aristotle’s Nicomachean Ethics (...) VII and X. In this paper, I offer a reconstruction of Alexander’s treatment of this difficulty, based on some passages from Alexander’s Ethical Problems and the Mantissa. I try to show that Alexander does not dismiss the so‑called “definition A” of pleasure as being spurious, although he obviously values more the definition B. Even if he never openly brands the definition A as “dialectic”, Alexander takes it as a reputable endoxon, which however needs to be emended in that it blurs the distinction between pleasure and activity. Pleasure only supervenes on the activity to which it is appropriate, and this supervenience is precisely what accounts for the inaccuracy of the definition A. As much as the child conflates the apparent good and the good, so the hedonist takes pleasure to be identical with the activity and the telos of human life. On the contrary, for Alexander, pleasure is actually only a sign of happiness and the shadow of the activity. (shrink)

Study on the philosophy of soul according to Islamic teachings.

Non-classical generalizations of classical modal logic have been developed in the contexts of constructive mathematics and natural language semantics. In this paper, we discuss a general approach to the semantics of non-classical modal logics via algebraic representation theorems. We begin with complete lattices L equipped with an antitone operation ¬ sending 1 to 0, a completely multiplicative operation ◻, and a completely additive operation ◊. Such lattice expansions can be represented by means of a set X together with binary relations (...) ⊲, R, and Q, satisfying some first-order conditions, used to represent (L,¬), ◻, and ◊, respectively. Indeed, any lattice L equipped with such a ¬, a multiplicative ◻, and an additive ◊ embeds into the lattice of propositions of a frame (X,⊲,R,Q). Building on our recent study of "fundamental logic", we focus on the case where ¬ is dually self-adjoint (a≤¬b implies b≤¬a) and ◊¬a≤¬◻a. In this case, the representations can be constrained so that R=Q, i.e., we need only add a single relation to (X,⊲) to represent both ◻ and ◊. Using these results, we prove that a system of fundamental modal logic is sound and complete with respect to an elementary class of bi-relational structures (X,⊲,R). (shrink)

This volume is a collection of essays concerned with the morality of hu man treatment of nonhuman animals. The contributors take very different approaches to their topics and come to widely divergent conclusions. The goal of the volume as a whole is to shed a brighter light upon an aspect of human life-our relations with the other animals-that has recently seen a great increase in interest and in the generation of heat. The discussions and debates contained herein are addressed by (...) the contributors to each other, to the general public, and to the academic world, especially the biological, philosophical, and political parts of that world. The essays are organized into eight sections by topics, each sec tion beginning with a brief introduction linking the papers and the sec tions to one another. There is also a general introduction and an Epilog that suggests alternate possible ways of organizing the material. The first two sections are concerned with the place of animals in the human world: Section I with the ways humans view animals in literature, philosophy, and other parts of human culture, and Section II with the place of animals in human legal and moral community. The next three sections concern comparisons between human and nonhuman animals: Section III on the rights and wrongs of killing, Section IV on the humanity of animals and the animality of humans, and Section V on questions of the conflict of human and animal interests. Background Euthanasia is a topic of intense ethical debate and it is illegal in most countries at present, including Sri Lanka. The aim of this descriptive cross-sectional study of medical students and practicing doctors was to explore the acceptance of euthanasia and physician assisted suicide, and factors influencing this opinion. Methods A customised online questionnaire which explored opinions on euthanasia was administered to first and final year medical undergraduates in University of Colombo and practicing doctors with more than 5 years (...) of work experience at The National Hospital of Sri Lanka. Attitudes on euthanasia and PAS were also assessed with the attitudes towards euthanasia Scale, which is a 10-item questionnaire. Results A total of 425 individuals responded, which included 143 first-year medical undergraduates, 141 final-year medical undergraduates and 141 practicing doctors. More participants favoured legalizing euthanasia than those directly opposing it, but a significant proportion remained undecided. The mean scores of ATE questionnaire from the whole sample were generally unfavourable towards euthanasia/PAS. Accepting euthanasia as an option for oneself was the strongest predictor of favouring euthanasia/PAS or supporting its legalization. Conclusion In this cross-sectional survey, more respondents supported legalisation of euthanasia in Sri Lanka than those openly opposing it. Yet, a significant minority that responded as “undecided” for legalisation, were more likely to have unfavourable ATE. (shrink)

The DAMA project is an observatory for rare processes and it is operative deep underground at the Gran Sasso National Laboratory of the I.N.F.N. In particular, the DAMA/LIBRA (Large sodium Iodide Bulk for RAre processes) set-up consists of highly radiopure NaI(Tl) detectors for a total sensitive exposed mass of ≃250 kg. Recent results, obtained by this set-up by exploiting the model independent annual modulation signature of Dark Matter (DM) particles, have confirmed and improved those obtained by the former DAMA/NaI experiment. (...) A model independent evidence for the presence of Dark Matter particles in the galactic halo is cumulatively obtained at 8.2 σ C.L. No systematics or side reactions able to account for the measured modulation amplitude and to contemporaneously satisfy all the many specific requirements of the signature have been found or suggested by anyone over more than a decade. An example of one of the many possible model dependent corollary quests for the candidate particles and for the related astrophysical, nuclear and particle physics scenarios is presented considering the whole cumulative exposure.
